Wedding Photography Contract
This agreement is made between Nicole Reid Photography (“Photographer”) and the undersigned Client(s) (“Client”) for wedding photography services.

A. Retainer & Payment
1. A non-refundable retainer of $200 is due at the time of booking to secure the wedding date. The retainer must be sent by EMT to nicolereidphoto@outlook.com.
2. The retainer is non-refundable and non-transferable under all circumstances, including if the Client cancels, postpones, changes their mind, or states they no longer require the Photographer’s services.
3. The retainer applies only to the original wedding date booked. If the date is changed, a new retainer is required to secure the new date, subject to Photographer availability.
4. The remaining balance may be paid by EMT, cash, or approved gift card, and must be paid no later than the day after the wedding. Services will not be rendered until payment is made in full.
5. Gift cards must be presented physically and do not expire, but are subject to booking availability.

B. Coverage & Location
1. The Photographer will provide coverage for the agreed-upon wedding date, times, and locations as discussed with the Client.
2. At this time I am only taking weddings booked within the Charlotte County area.
3. The Client is responsible for securing all permits or permissions for chosen venues and for covering any associated costs.

C. Cancellation, Rescheduling & Substitution
1. If the Client cancels the wedding, changes plans, hires another photographer, or states that they no longer require the Photographer’s services, the retainer will not be refunded under any circumstances.
2. Payments made beyond the retainer will be refunded only if cancellation occurs more than 60 days prior to the wedding. If cancellation occurs within 60 days of the wedding, all monies paid are non-refundable.
3. If the Client reschedules, a new retainer is required, and the Photographer cannot guarantee availability for the new date.
4. If the Photographer cannot attend due to illness, accident, or emergency, all reasonable efforts will be made to secure a qualified replacement photographer. If a replacement is not available, all monies paid (including the retainer) will be refunded, and this contract will be terminated with no further liability.
5. In cases of force majeure (natural disasters, pandemics, extreme weather, government restrictions, or events beyond the Photographer’s control), liability is limited to rescheduling (if possible) or refunding payments made, minus the retainer.

D. Image Delivery & Retention
1. Edited, high-resolution images will be delivered via an online gallery. The gallery will remain active for one month. Reactivation of an expired gallery will incur a $25 fee.
2. Images will be archived for six months after delivery, at which point they may be permanently deleted. Clients are responsible for downloading and backing up their images.
3. RAW files are never delivered. Clients will only receive edited JPEG images.
4. The Photographer retains full copyright. The Client receives a personal-use license (printing, sharing, personal display). Images may not be altered, sold, or used commercially without written permission.
5. Editing includes color correction and light retouching. Extensive Photoshop work or body alterations are not included. Temporary blemishes may be removed at the Photographer’s discretion.

E. Client Responsibilities
1. The Client should provide some sort of wedding timeline, addresses, and requested group/family photo list prior to the event. This does not need to be formal.
2. The Client should designate a family member or wedding coordinator to assist in organizing group photos. The Photographer is not responsible for missing individuals not present during the scheduled photo time.
3. The Client is responsible for ensuring the Photographer has access to all venues, reasonable time for portraits, and a meal break during full-day coverage.
4. The Photographer is not responsible for guest interference (e.g., cell phone cameras, flashes, DJ lights or guests obstructing shots).

F. Liability & Limitations
1. The Photographer will take every reasonable precaution to produce high-quality images. However, the Photographer is not liable for:
• Missed shots due to lateness, restrictions, or interference.
• Lighting or venue restrictions that impact quality.
• Acts of God, accidents, or emergencies outside Photographer’s control.
2. In the unlikely event of total photographic failure (all images lost, corrupted, or destroyed), liability is limited to a full refund of all monies paid.
3. The Photographer uses professional equipment and backup systems but is not responsible for unavoidable technical failures, theft, or damage.

G. Delivery Timeline
1. Wedding galleries are typically delivered within 8–12 weeks.
2. Delivery time may vary depending on season and workload. Updates will not be provided during the editing process unless delivery exceeds 12 weeks.
3. Sneak peeks may be posted within 48 hours of wedding completion should the couple approve.

H. Conduct & Professionalism
1. Both Client and Photographer agree to act respectfully and professionally.
2. The Photographer reserves the right to leave the event if subjected to unsafe, hostile, or abusive behavior by the Client, guests, or vendors. No refund will be issued in such circumstances.
