General Photography Contract
This agreement is made between Nicole Reid Photography (“Photographer”) and the undersigned Client(s) (“Client”) for photography services.

A. Payment
1. Full payment for the session is due at the time of the session by EMT, cash, or approved gift card.
2. Payment must be received before any photos are edited.
3. Gift cards must be presented physically and are subject to availability. Gift cards do not expire but may not guarantee immediate booking during busy times.

B. Session Length & Coverage
1. Sessions are scheduled for up to one hour in length.
2. Sessions may run shorter at the Photographer’s discretion once a substantial number of photographs have been captured. No additional time or refund will be given for sessions that conclude early.
3. The Photographer determines when a sufficient variety of images have been obtained.

C. Cancellation, Rescheduling & No-Shows
1. If the Client cancels or does not attend their session, payment remains due in full.
2. Rescheduling may be allowed if requested at least 24 hours in advance, subject to Photographer availability.
3. Sessions canceled or rescheduled with less than 24 hours’ notice will be treated as a cancellation and payment will not be refunded.
4. If the Photographer must cancel due to illness, emergency, or unforeseen circumstances, the session will be rescheduled at no additional cost. If rescheduling is not possible, any payment received will be refunded.
5. In cases of force majeure (severe weather, accidents, natural disasters, government restrictions, or events beyond Photographer’s control), the session may be rescheduled if possible. Refunds will only be issued at the Photographer’s discretion.

D. Location
1. Sessions within 15 km of St. Stephen, NB are included. Travel beyond this range may incur fees beginning at $25, plus possible accommodation if overnight stay is required.
2. The Client is responsible for obtaining permission or permits for chosen locations and covering any associated costs.
3. The Photographer reserves the right to refuse unsafe or unsuitable locations.

E. Image Delivery & Retention
1. Edited, high-resolution images will be delivered via an online gallery, available for one month. A $25 fee applies to reactivate expired galleries.
2. The Photographer will retain images for six months after delivery, at which time they may be permanently deleted. Clients are responsible for downloading and backing up their images.
3. RAW files are never delivered. Clients will only receive edited JPEGs.
4. Photographer retains full copyright and provides Clients with a personal-use license. Images may not be altered, sold, or used commercially without written permission.
5. Editing includes standard color correction and light retouching. Extensive Photoshop edits (body alterations, wardrobe fixes, etc.) are not included. Temporary blemishes may be removed at the Photographer’s discretion.

F. Client Responsibilities
1. Clients must arrive on time. Sessions delayed due to late arrival will not be extended.
2. Clients are responsible for the behavior of children and guests during the session. The Photographer is not responsible for missed images due to uncooperative behavior.
3. The Photographer is not responsible for interference by guests (e.g., cameras, phones, or interruptions).

G. Liability & Limitations
1. The Photographer will take all reasonable precautions to produce high-quality images. However, the Photographer is not responsible for:
• Missed images due to lateness, weather, cooperation of subjects, or external interference.
• Venue restrictions, lighting conditions, or environmental factors beyond Photographer’s control.
• Acts of God, accidents, or emergencies.
2. In the unlikely event of total photographic failure (all images lost, corrupted, or destroyed), liability is limited to refunding payments received or rebooking of the session.
3. The Photographer uses professional equipment and backups but is not liable for unavoidable technical failures, theft, or damage.

H. Delivery Timeline
1. Session images are typically delivered within 2–3 weeks.
2. Delivery times may vary based on season and workload.

I. Conduct & Professionalism
1. Both Client and Photographer agree to treat one another with respect and courtesy.
2. The Photographer reserves the right to end the session if subjected to unsafe, hostile, or inappropriate behavior by the Client or guests. In such cases, no refund will be issued.
